Introduction

The LINC-LV.org site and associated DEI.LINC-LV.org site (the “Site”) is an offering of Lehigh Valley Inter-Regional Networking & Connecting Consortium (“LINC”), an organization located in Pennsylvania, United States.

LINC is committed to protecting your personal information. This privacy statement explains how we treat your personal information when you use the Site. By using the Site and submitting any personal information, you agree to the terms of this statement.

‘LINC,’ ‘we’ and ‘us’ refer to Lehigh Valley Inter-Regional Networking & Connecting Consortium.

Information collection

We collect personal information voluntarily provided by you through the Site, for example, when you pledge or email the Site administrators, which could include identifiers such as your name, email address and phone number. We also collect information about your device, browser, IP address and general location when you use the Site.

LINC does not intend to collect sensitive personal information about you through the Site. Sensitive personal information includes a number of types of data relating to: race or ethnic origin; political opinions; religious or other similar beliefs; trade union membership; physical or mental health; sexual life or criminal record. If you provide sensitive personal information to LINC through the Site, you do so voluntarily and LINC accepts your consent for us to collect, store and use your sensitive personal information in the same ways as other personal information we collect.

Information use

The primary purposes for which LINC collects your personal information on the Site and for which LINC may use it are to respond to any inquiries you make through the “contact us” function and to send you content and information via email about LINC Diversity, Equity, and Inclusion resources and announcements. Please see “Your Choices” below for instructions on how you may unsubscribe from receiving such communications. Other purposes for which LINC may use your personal information are: 

  • To operate, administer, manage and improve the Site and the user experience
  • To conduct data analysis regarding the performance and use of the Site and the demographics of its users for use by LINC
  • To maintain and improve the safety and security of the Site
  • To prevent and enhance protection against fraud, spam, harassment, intellectual property infringement, crime and security risks
  • To comply with law and legal obligations as well as professional standards and firm policies

The Site does not intend to collect or compile personal information for dissemination or sale to outside parties for consumer marketing purposes, or host mailings on behalf of third parties.

Cookies and other online identification technologies

Cookies and other online identification technologies such as pixels and web beacons (“Tracking Technologies”) may be used on some pages of the Site. “Cookies” are small text files placed on your device that assist us in providing a more customized website experience. For example, a cookie can be used to store registration information in an area of the site so that a user does not need to re-enter it on subsequent visits to that area. It is LINC’s policy to use cookies to make navigation of our websites easier for visitors and to facilitate efficient registration procedures. Site statistics are compiled by third parties and therefore your IP address will be passed to third parties for statistical reporting only.

LINC may use Tracking Technologies from marketing partners on our Site, third party sites, and social media platforms. These Tracking Technologies aid in measuring the efficacy of our marketing and awareness campaigns and to understand how visitors navigate to our Site from a LINC ad. We may use these technologies to compile aggregated statistics about visitors who interact with LINC online content, to gauge the effectiveness of our ads and to better provide more pertinent information to our visitors.

In most cases, a visitor may refuse a cookie and still fully navigate our website; however, other functionality in the site may be impaired. In order to properly manage our website, we may anonymously log information on our operational systems, and identify categories of visitors by items such as domains and browser types. These statistics are reported in the aggregate to our webmasters. This is to ensure that our website presents the best web experience for visitors and is an effective information resource.

Information sharing

In common with other professional service providers, LINC may transfer or disclose the information it collects, including your information, to third party contractors or subcontractors for the purposes for which you have submitted the information and for the administration of our system or Site and/or other internal, administrative purposes. We transfer your information to third party service providers of identity management, website hosting and management, data analysis, data backup, security and storage services.

LINC may also disclose information to third parties under the following circumstances:

  • As required by applicable law, statute, rule, regulation or professional standard, or through subpoena, search warrant or other legal process

  • When explicitly requested by a visitor
  • When required to deliver publications or reference materials requested by a visitor

Where permitted by law, you may use an authorized agent to submit a request on your behalf if you have provided the authorized agent written and signed permission to do so. We may not be able to fulfill your request if we cannot verify your identity or authority to make the request and confirm the personal information relates to you. Making a verifiable request does not require you to create an account with us. We will only use personal information provided in a verifiable request to verify the requestor’s identity or authority to make the request.

We will respond to your request within a reasonable timeframe in accordance with applicable law. We reserve the right to charge an appropriate fee for complying with a request where permitted by applicable law, and to deny a request where it may be manifestly unfounded, excessive, or unwarranted under applicable law.

Security

LINC has implemented generally accepted standards of technology and operational security designed to protect personal information from loss, misuse, alteration or destruction. Only authorized LINC personnel are provided access to personal information and these employees have agreed to maintain the confidentiality of this information.

LINC understands the importance of protecting children’s privacy, especially in an online environment. The Site is not intentionally designed for or directed at children under the age of 18 years. It is LINC’s policy never to knowingly collect or maintain personal information about children under the age of 18.

This Privacy Notice for California Residents supplements the information contained in LINC’s general Privacy Policy above, and applies solely to all visitors, users, and others who reside in the State of California (“consumers” or “you”). In the preceding twelve (12) months, LINC has not sold personal information.

Your Rights and Choices

The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

Access to Specific Information and Data Portability Rights

You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

  • The categories of personal information we collected about you.
  • The categories of sources for the personal information we collected about you.
  • Our business or commercial purpose for collecting or selling that personal information.
  • The categories of third parties with whom we share that personal information.
  • The specific pieces of personal information we collected about you (also called a data portability request).
  • If we sold or disclosed your personal information for a business purpose, two separate lists disclosing:
    • sales, identifying the personal information categories that each category of recipient purchased; and

Deletion Request Rights

You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you.

Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.

Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.

Comply with a legal obligation.

Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Exercising Access, Data Portability, and Deletion Rights

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by either:

Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child or a child for whom you are the legal guardian.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative, which may include:

Name, address, telephone, number, and/or email address.

Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.

Making a verifiable consumer request does not require you to create an account with us.

We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Response Timing and Format

We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.

If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

No Sale of Personal Information

We do not currently sell any personal information (including personal information of users we actually know are less than 21 years of age).

Non-Discrimination

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:

Deny you goods or services.

Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.

Provide you a different level or quality of goods or services.

Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.
